Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and StayIn Poker, Inc. ("StayIn Poker," "we," "us," or "our") governing your access to and use of the StayIn Poker mobile and web applications, websites, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service offers simulated, play-money card games for entertainment only and is not available where such games are prohibited. By using the Service you represent that your use is lawful in your jurisdiction.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

You may not create more than one account, share an account, or use another person's account without permission.

3. Virtual Currency — No Real-World Value

StayIn Poker uses a virtual, in-app currency ("StayIn Bucks"). StayIn Bucks and any other virtual items:

• have no monetary value and are not real currency or legal tender;
• cannot be redeemed, exchanged, or cashed out for real money, goods, or anything of value outside the Service;
• are licensed to you, not sold, and are non-transferable except within gameplay as the Service allows;
• may be adjusted, expired, or forfeited in accordance with these Terms.

The games are intended for entertainment. The Service does not offer real-money gambling, prizes, or payouts. Winning or losing virtual currency has no effect on your real-world finances.

4. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial entertainment. You may not copy, modify, reverse engineer, resell, or create derivative works from the Service except as permitted by law.

5. Live Video & Audio

The Service connects you with another player over live video and audio. By starting a game you consent to your camera and microphone being shared in real time with your opponent for the duration of the match. You are responsible for what you transmit. Do not broadcast anything unlawful, harmful, or that violates our Acceptable Use & Community Guidelines.

On-device technology checks whether your face remains in frame and may apply in-game penalties (such as a shortened action timer or an auto-fold) if you leave the camera view. This is part of fair play and is described in the app.

6. Fair Play & Prohibited Conduct

You agree not to cheat, collude, use bots or automation, exploit bugs, manipulate the video feed (for example, by playing a recorded or virtual image instead of your live presence), or otherwise gain an unfair advantage. Your conduct is also governed by our Acceptable Use & Community Guidelines, which are incorporated into these Terms.

7. Intellectual Property

The Service, including its software, design, logos, and content, is owned by StayIn Poker, Inc. or its licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAYIN POKER, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnification

You agree to indemnify and hold harmless StayIn Poker, Inc. and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware, United States for any dispute not subject to arbitration, where applicable.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use after changes take effect constitutes acceptance.
