End User License Agreement

This End User License Agreement ("EULA") governs your use of the StayIn Poker application (the "Licensed Application") provided by StayIn Poker, Inc. ("Licensor"). The Licensed Application is licensed, not sold, to you. This EULA incorporates our Terms of Service.

1. Scope of License

Licensor grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

2. Maintenance and Support

Licensor is solely responsible for providing maintenance and support for the Licensed Application, as specified in this EULA or as required by law. Apple has no obligation to furnish any maintenance or support services. Support requests may be directed to [email protected].

3. Warranty

Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are Licensor's sole responsibility.

4. Product Claims

Licensor, not Apple, is responsible for addressing any claims by you or a third party relating to the Licensed Application or your use of it, including: (a) product-liability claims; (b) any claim that the Licensed Application fails to conform to legal or regulatory requirements; and (c) claims arising under consumer-protection, privacy, or similar legislation.

5. Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, Licensor, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

6. Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

7. Developer Name and Address

The Licensed Application is provided by StayIn Poker, Inc.. For questions, complaints, or claims regarding the Licensed Application, contact [email protected].

8. Third-Party Terms & Beneficiary

You must comply with applicable third-party terms when using the Licensed Application. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
